BREAKING: Appeal Court Affirms Judgment Barring INEC from Recognising David Mark-Led ADC Leadership, Dismisses Appeal

The Court of Appeal has affirmed the judgment of the Federal High Court restraining the Independent National Electoral Commission (INEC) from recognising or participating in any congresses, conventions, or activities organised by the leadership of the African Democratic Congress (ADC) led by former Senate President, Senator David Mark.

In a judgment delivered on Monday, the appellate court dismissed the appeal filed by Senator David Mark, former Osun State Governor Rauf Aregbesola, and other appellants, describing it as lacking in merit.

The court also awarded ₦10 million in costs against the appellants.

The ruling upholds the earlier decision of the Federal High Court, which barred INEC from recognising the David Mark-led leadership pending the determination of the substantive issues surrounding the party’s leadership dispute.

The legal battle stems from the lingering leadership crisis within the ADC following disagreements over the party’s national leadership and the conduct of its internal affairs.

With the Court of Appeal’s decision, the earlier orders of the Federal High Court remain in force, meaning INEC is restrained from recognising or participating in congresses or other activities organised by the David Mark-led faction unless the judgment is set aside by the Supreme Court.

The ruling is expected to have significant implications for the ongoing leadership tussle within the ADC and could shape the party’s preparations ahead of future political activities.
